Important Notice

These International Terms & Conditions govern shipments booked with or accepted by Dynamic International Courier & Cargo.

By placing a shipment with Dynamic International Courier & Cargo, the person or entity sending the shipment (“Shipper”) confirms that these Terms & Conditions are accepted on behalf of the Shipper and any other person having an interest in the shipment.

These Terms & Conditions shall apply from the time the shipment is accepted by Dynamic International Courier & Cargo unless otherwise agreed in writing by an authorised representative of Dynamic International Courier & Cargo.

Nothing in these Terms & Conditions is intended to restrict any statutory rights available to a customer under applicable law.

For the purpose of these Terms:

  • “Shipment” means one or more documents, parcels, packages or consignments transported under a single waybill, airway bill, consignment note, shipping label or booking reference.
  • “Waybill” includes any airway bill, shipping label, consignment note, electronic booking document or other transport document issued or generated for a shipment.

Dynamic International Courier & Cargo may transport a shipment directly or through airlines, courier networks, postal operators, freight companies, road transporters, customs agents, overseas partners or other third-party service providers.

Unless additional shipment protection or insurance is purchased, shipments are carried subject to the liability limitations described in these Terms & Conditions.

1. Customs, Export and Import Formalities

For the purpose of arranging international transportation and customs clearance, the Shipper authorises Dynamic International Courier & Cargo, where necessary, to act on the Shipper’s behalf.

Dynamic International Courier & Cargo may:

  • Prepare, complete or submit shipping, customs, export or import documentation using the information supplied by the Shipper.

The Shipper remains responsible for providing complete, accurate and lawful information relating to the shipment.

The Shipper must ensure that all goods handed over to Dynamic International Courier & Cargo are legally acceptable for transportation.

Dynamic International Courier & Cargo may refuse, suspend, return or stop transportation of any shipment that:

  • Contains goods classified as dangerous goods, hazardous materials, prohibited items or restricted articles under applicable laws, regulations or transportation rules.

The Shipper should confirm product eligibility with Dynamic International Courier & Cargo before booking where there is any uncertainty.

3. Delivery and Undeliverable Shipments

Shipments will be delivered to the delivery address provided by the Shipper and may not necessarily be handed personally to the named Receiver.

Where a shipment is addressed to an office building, residential complex, warehouse, institution, mail room, security desk, reception area or central receiving facility, delivery to the authorised receiving point may constitute valid delivery.

Delivery to P.O. boxes or other non-serviceable addresses may not be available unless supported by the applicable destination service.

The Shipper is responsible for providing complete and accurate details including, where applicable:

  • Receiver’s full name.
  • Complete delivery address.
  • Postal or ZIP code.
  • City and country.
  • Contact telephone number.
  • Email address.
  • Tax, customs or identification information required by the destination country.

If a shipment cannot be delivered because:

  • The Receiver refuses to accept the shipment.
  • The Receiver refuses to pay applicable duties, taxes or charges.
  • The address is incorrect or incomplete.
  • The Receiver cannot reasonably be contacted or located.
  • The shipment is prohibited or unacceptable.
  • The shipment has been undervalued or incorrectly declared.
  • Customs clearance cannot be completed.
  • Required documents are unavailable.

Dynamic International Courier & Cargo may attempt to contact the Shipper or Receiver and may arrange return, storage, disposal, abandonment or other handling of the shipment.

Any return transportation, storage, customs, handling, disposal or administrative charges may be charged to the Shipper.

Where a shipment cannot reasonably be returned or delivered, Dynamic International Courier & Cargo may, subject to applicable law, dispose of, abandon, destroy or sell the shipment where legally permitted.

Any proceeds received from a lawful sale may first be used to recover freight charges, duties, storage, handling and administrative expenses. Any remaining balance may be returned to the person legally entitled to receive it.

4. Right of Inspection

Dynamic International Courier & Cargo, its service partners, customs authorities, security agencies or other competent authorities may inspect, scan, open or examine a shipment where reasonably necessary for:

  • Security screening.
  • Customs clearance.
  • Legal or regulatory compliance.
  • Verification of shipment contents.
  • Transportation safety.
  • Investigation of suspected prohibited or restricted items.

Such inspection may take place without prior notice to the Shipper where permitted by applicable law.

5. Shipment Charges, Weight and Billing

Shipping charges may be calculated based on:

  • Actual weight.
  • Volumetric or dimensional weight.
  • Destination.
  • Service type.
  • Package dimensions.
  • Nature of goods.
  • Remote-area charges.
  • Fuel surcharge.
  • Customs handling.
  • Special handling requirements.
  • Other applicable service charges.

Where volumetric weight exceeds actual weight, the higher chargeable weight may be used for billing.

Dynamic International Courier & Cargo may re-weigh or re-measure any shipment after acceptance. If the actual dimensions or weight differ from the details originally supplied by the Shipper, the applicable shipping charge may be adjusted.

The Shipper agrees to pay or reimburse Dynamic International Courier & Cargo for all applicable:

  • Transportation charges.
  • Customs duties.
  • Taxes.
  • Storage fees.
  • Clearance charges.
  • Return charges.
  • Remote-area surcharges.
  • Handling fees.
  • Government charges.
  • Fines or penalties resulting from inaccurate shipment information.
  • Costs caused by prohibited, restricted, incorrectly declared or unacceptable shipments.

Where Dynamic International Courier & Cargo advances any amount on behalf of the Shipper or Receiver, such amount may be recovered from the Shipper together with applicable service or administrative charges.

6. Liability of Dynamic International Courier & Cargo

Dynamic International Courier & Cargo’s liability is limited to direct physical loss of or damage to a shipment, subject to these Terms & Conditions and any mandatory liability rules imposed by applicable law or international transportation conventions.

Dynamic International Courier & Cargo shall not be responsible for indirect, incidental, special or consequential losses, including but not limited to:

  • Loss of profit.
  • Loss of income.
  • Loss of business.
  • Loss of contract.
  • Loss of opportunity.
  • Loss of interest.
  • Loss of anticipated savings.
  • Loss arising from business interruption.

This limitation applies even where Dynamic International Courier & Cargo has been informed that such losses may occur.

Unless a higher declared value, shipment protection or insurance arrangement has been accepted in writing, Dynamic International Courier & Cargo’s liability for any one shipment shall be limited to the actual value of the lost or damaged goods and shall remain subject to any applicable contractual or statutory liability limit.

Where legally permitted and unless a different mandatory liability limit applies, the maximum liability for a shipment shall not exceed US $100 or its equivalent in the applicable currency.

For postal or economy services where separate postal-network liability rules apply, liability may be limited to US $10 or its equivalent in the applicable currency, unless otherwise expressly stated for the relevant service.

Only one claim may be made in respect of a single shipment.

Payment or settlement of an accepted claim shall constitute full and final settlement of Dynamic International Courier & Cargo’s liability for the relevant loss or damage.

Where the Shipper considers the standard liability limit inadequate, the Shipper should request additional shipment protection or insurance before the shipment is accepted.

7. Time Limit for Claims

Any claim for loss of or damage to a shipment must be submitted to Dynamic International Courier & Cargo in writing within thirty (30) days from the date the shipment was accepted, unless a different mandatory claim period applies under applicable law or an international transportation convention.

The claim should include supporting documentation requested by Dynamic International Courier & Cargo, which may include:

  • Waybill or booking reference.
  • Commercial invoice.
  • Proof of value.
  • Photographs of damage.
  • Packaging photographs.
  • Receiver confirmation.
  • Customs documents.
  • Other relevant evidence.

Failure to submit a claim within the applicable time period may result in the claim being rejected, subject to mandatory legal rights.

8. Shipment Insurance / Shipment Protection

Where available, Dynamic International Courier & Cargo may assist the Shipper in arranging shipment insurance or other shipment-protection services for an additional charge.

The Shipper must specifically request such cover before the shipment is transported and must provide an accurate declared value.

Any applicable premium or protection fee must be paid in accordance with the booking requirements.

Shipment insurance or protection is generally intended to cover direct physical loss of or physical damage to insured goods, subject to the terms, conditions, limitations and exclusions of the relevant insurance or protection arrangement.

Unless specifically covered under the applicable policy or arrangement, shipment insurance does not normally cover:

  • Delay.
  • Consequential loss.
  • Loss of profit.
  • Loss of business.
  • Market depreciation.
  • Indirect financial loss.

Where insurance is arranged through a third-party insurer, settlement will also be subject to that insurer’s policy terms and claim requirements.

9. Delayed Shipments

Dynamic International Courier & Cargo will use reasonable efforts to transport and deliver shipments according to estimated transit schedules.

However, estimated pickup, transit, customs clearance and delivery times are not guaranteed unless Dynamic International Courier & Cargo expressly confirms a guaranteed service in writing.

Delivery may be affected by factors including:

  • Customs clearance.
  • Airline schedules.
  • Security screening.
  • Weather.
  • Public holidays.
  • Local delivery conditions.
  • Flight cancellations.
  • Government restrictions.
  • Receiver availability.
  • Incomplete documentation.
  • Events beyond reasonable operational control.

Unless otherwise required by applicable law or an expressly guaranteed service, Dynamic International Courier & Cargo shall not be responsible for loss or damage arising solely from delay.

10. Circumstances Beyond Dynamic International Courier & Cargo’s Control

Dynamic International Courier & Cargo shall not be responsible for loss, damage, delay or failure of service resulting from circumstances beyond its reasonable control.

Such circumstances may include, without limitation:

  • Earthquake.
  • Cyclone.
  • Storm.
  • Flood.
  • Fire.
  • Fog.
  • Natural disaster.
  • War.
  • Terrorism.
  • Civil disturbance.
  • Riot.
  • Embargo.
  • Government action.
  • Border closure.
  • Customs action.
  • Airport closure.
  • Aircraft accident.
  • Industrial action or strikes.
  • Epidemics or pandemics.
  • Transportation disruption.
  • Power or communications failure.
  • Acts or omissions of the Shipper.
  • Acts or omissions of the Receiver.
  • Acts or omissions of customs authorities or government officials.
  • Acts or omissions of third parties outside Dynamic International Courier & Cargo’s reasonable control.

Dynamic International Courier & Cargo shall also not be responsible for loss or damage arising from an inherent defect, weakness, deterioration, characteristic or nature of the goods themselves.

This may include damage to sensitive electronic, magnetic, photographic or digital media where the loss results from the inherent nature or sensitivity of such media.

11. International Air Carriage Conventions

Where a shipment is transported internationally by air, liability for loss, damage or delay may be governed by mandatory international transportation conventions and applicable national legislation.

Depending on the origin, destination, routing and countries involved, the Montreal Convention 1999, the Warsaw Convention, or another applicable international air-carriage regime may govern and limit the liability of the carrier.

Where a mandatory international convention applies, its provisions shall prevail to the extent they conflict with these Terms & Conditions.

12. Shipper’s Warranties and Indemnity

The Shipper represents and warrants that:

  • All shipment information provided to Dynamic International Courier & Cargo is true, complete and accurate.
  • The shipment has been correctly described.
  • The declared value is accurate.
  • The shipment has been properly prepared and packed.
  • The shipment has been protected from unauthorised interference before handover.
  • The shipment is correctly marked and labelled.
  • The Receiver’s address and contact information are accurate.
  • The shipment complies with customs, export, import, sanctions, aviation, security and other applicable legal requirements.
  • All permits, licences, certificates and approvals required for transportation have been obtained.
  • The person making the booking is authorised to accept these Terms & Conditions on behalf of the Shipper.

The Shipper agrees to indemnify and hold Dynamic International Courier & Cargo, its employees, agents, partners and service providers harmless against losses, claims, penalties, expenses, duties, taxes, fines or liabilities arising from:

  • Incorrect or incomplete declarations.
  • Illegal or prohibited goods.
  • Breach of these Terms & Conditions.
  • Breach of applicable law.
  • Inadequate packaging.
  • Incorrect customs documentation.
  • Misrepresentation of shipment contents or value.
  • Any act or omission of the Shipper that causes liability to Dynamic International Courier & Cargo or its transportation partners.

13. Routing and Transportation

The Shipper authorises Dynamic International Courier & Cargo to select the transportation route, carrier, airline, courier network, service partner, customs broker or other method considered appropriate for the shipment.

A shipment may:

  • Travel through one or more transit countries.
  • Pass through intermediate airports or hubs.
  • Be consolidated with other shipments.
  • Be transferred between transportation providers.
  • Be diverted or rerouted where operationally necessary.

The route shown at the time of booking is not necessarily the route that will ultimately be used.

14. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by applicable law, including any mandatory transportation, customs, consumer-protection or international carriage rules that apply to the shipment.

Unless otherwise required by applicable law or a mandatory international convention, disputes relating to services provided by Dynamic International Courier & Cargo shall be subject to the jurisdiction of the competent courts applicable to the relevant Dynamic International Courier & Cargo contracting entity and the place from which the service was contracted.

Nothing in this clause shall override any jurisdiction or statutory rights that cannot legally be excluded or restricted.

15. Country-Specific Terms and Regulatory Requirements

International courier and cargo services are subject to different laws, customs requirements, security rules, import controls and transportation regulations depending on the origin, transit and destination countries.

Accordingly, additional conditions, limitations, documentation requirements or restrictions may apply to a shipment based on the countries involved.

These Terms & Conditions should therefore be read together with:

  • Applicable customs regulations.
  • Import and export laws.
  • Government requirements.
  • Airline or carrier restrictions.
  • Destination-country regulations.
  • Service-specific conditions communicated by Dynamic International Courier & Cargo.

Where any provision of these Terms conflicts with a mandatory law or regulation, the mandatory requirement shall apply.

16. Severability

If any provision of these Terms & Conditions is held by a competent authority or court to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary.

The invalidity or unenforceability of one provision shall not affect the validity or enforceability of the remaining provisions.

Acceptance of Terms

By booking, handing over or authorising transportation of a shipment through Dynamic International Courier & Cargo, the Shipper acknowledges that they have read, understood and agreed to these International Terms & Conditions.

The Shipper is responsible for ensuring that any person acting on their behalf is aware of and complies with these Terms.
